Terms of Use
These Terms of Use ("Terms") govern your use of lendermatch.io (the "Site"), operated by LMK Media LLC, doing business as LenderMatch.io ("LenderMatch," "we," "us"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
What LenderMatch is (and isn't)
LenderMatch is an online platform that connects borrowers with participating lenders. We are not a lender, bank, or mortgage broker. We do not make loans, take applications, quote rates, or make credit decisions. Any loan you obtain is between you and the lender you choose, on terms set by that lender. We do not guarantee that you will be matched, contacted, approved, or offered any particular rate or terms. Figures shown on the Site are illustrative only and are not an offer to lend.
Eligibility
The Site is intended for U.S. residents who are at least 18 years old.
Your request and your consents
When you submit a request, you agree that the information you provide is accurate and about yourself. Where you give consent to be contacted, that consent is described at the point you give it and covers the participating lenders disclosed on our partner network page. You may revoke contact consent at any time as described on our opt-out page. Text messages from LenderMatch are governed by our SMS Terms.
Acceptable use
You agree not to submit false or third-party information without authority, interfere with the Site's operation, scrape or harvest data, reverse engineer, or use the Site for any unlawful purpose. We may suspend or terminate access for violations.
Intellectual property
The Site, including its design, text, graphics, and logos, is owned by or licensed to LMK Media LLC and protected by law. You may not copy, reproduce, or create derivative works from the Site except as permitted for personal, non-commercial use.
Third parties
Participating lenders are independent companies. We are not responsible for their products, rates, decisions, websites, or acts and omissions. Your dealings with any lender are solely between you and that lender.
Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing on the Site is financial, legal, or tax advice.
Limitation of liability
To the maximum extent permitted by law, LMK Media LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Site. Our total liability for any claim will not exceed one hundred dollars ($100).
Indemnification
You agree to indemnify and hold harmless LMK Media LLC from claims arising out of your violation of these Terms or your misuse of the Site.
Dispute resolution and arbitration
Any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and LenderMatch each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision within 30 days of first using the Site by emailing contact@lendermatch.io with the subject "Arbitration opt-out."
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Venue for any matter not subject to arbitration lies in Placer County, California.
Changes
We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance. The current version will always be posted at this page.
