HELOCs in Wisconsin: how much you can borrow and the state rules that apply

Own a home in Wisconsin and want cash without giving up the rate on your current mortgage? A home equity line of credit can do that. Wisconsin has no special HELOC borrowing cap, but as a marital property state it requires both spouses to sign for a homestead, and it sets out how a paid-off line gets closed and the lien cleared. Here is what that means for you.

Median value of an owner-occupied Wisconsin home
$294,700
Change in Wisconsin home prices over 5 years
+46.0%
Owed to you if the lender is late recording the release of a paid-off loan

HELOC rates in Wisconsin right now

Most HELOCs have a variable rate based on the prime rate plus a margin set by the lender. Your margin depends mostly on your credit and how much of your home's value you borrow.

In 2025, the median HELOC in Wisconsin opened at 7.25%, and half opened between 6.50% and 7.75%, across 26,623 lines reported under federal HMDA data. The national median was 7.50%. Leaving out lines with a 3 to 12 month introductory rate, the Wisconsin median was 7.25%. Home equity loans in Wisconsin, which usually have a fixed rate, closed at a median of 7.63%. The Federal Reserve raised rates on September 16, 2026, which moved prime to 7.00%. Its October 27 and 28 meeting is more recent than the prime rate data shown here, which runs through October 27, 2026. Its next meeting is December 8 and 9. With 30-year mortgage rates above 7%, a HELOC lets you borrow against your equity without refinancing a lower rate you already have.

How much can you borrow in Wisconsin?

Wisconsin law doesn't set a home equity borrowing cap. Each lender sets its own limit on all the loans on your home combined, your current mortgage plus the new line.

Wisconsin home prices more than doubled from 2014 to 2025 on the FHFA index, so owners who bought before 2021 have seen the biggest gains in equity.

The Wisconsin rules that affect a HELOC, in plain English

Wisconsin has no special HELOC limits like a borrowing cap or a waiting period. These Wisconsin laws (the Wisconsin Statutes) still shape your HELOC.

Spouses and marital property

Marital property.
Wisconsin presumes that all property of spouses is marital property, and each spouse owns an undivided half of it.
Both spouses sign for a homestead.
If you are married, a HELOC mortgage on your homestead must be signed by both spouses, even if only one of you is on the title. A Wisconsin court has held a mortgage signed by only one married owner invalid from the start.
Property in both names takes both of you.
Marital property titled in both spouses' names can only be managed by both acting together, and one spouse alone cannot mortgage marital property to get credit.
Family debts reach marital property.
A debt one spouse takes on during the marriage is presumed to be for the family, and a family debt can be paid from all marital property plus the borrowing spouse's own property.

Paying off and closing your line

Payoff figure in 7 business days.
Ask for a payoff statement and the lender must send it within 7 business days. On a home, it can't say the amount is subject to change before the payoff date.
Ask to close the line.
For a line of credit, the lien release clock starts once the lender has both your full payoff and your request to terminate the line.
30 days to clear the lien.
After that, the lender has 30 days to record the satisfaction. If it is late, it owes you $500 plus any actual damages, attorney fees and court costs.

Taxes and licensing

No transfer fee on a HELOC.
Wisconsin's real estate transfer fee of 30 cents per $100 applies to conveyances, but the law exempts one made solely to provide security for a debt, which is what your HELOC mortgage is.
Use a licensed lender.
Mortgage bankers and brokers need a license from the Wisconsin Division of Banking. Banks, credit unions and other depository institutions are exempt.

If you can't pay

A court judgment first.
In a Wisconsin foreclosure case, the court enters a judgment of foreclosure and sale, no sooner than 20 days after a notice of the pending case (a lis pendens) is filed.
A wait before any sale.
For an owner-occupied home of 1 to 4 units, the sale must wait 6 months after the judgment if the mortgage was signed on or after April 27, 2016, or 12 months for older mortgages. It can be 3 months if the lender gives up any claim for a remaining balance.
Redeem any time before the sale.
You can keep the home by paying the judgment, interest, costs and any taxes the lender paid, at any time before the sale.
You could still owe a balance.
Unless the lender waives it, it can ask the court for a deficiency judgment for any amount the sale doesn't cover.
Homestead protection doesn't cover a HELOC.
Wisconsin protects up to $75,000 of a homestead per spouse from most creditors, but the law expressly excepts mortgages.

Frequently asked questions

Does my spouse have to sign my Wisconsin HELOC?

If you are married and the home is your homestead, yes. Wisconsin law requires each spouse to sign a mortgage on the homestead, and a court has held a mortgage signed by only one married owner invalid.

Can a HELOC one spouse takes out be collected from marital property?

It can. A debt one spouse takes on during the marriage is presumed to be for the family, and Wisconsin lets a family debt be paid from all marital property plus that spouse's own property.

How do I close my HELOC and clear the lien in Wisconsin?

Pay the balance and send the lender a request to terminate the line. The lender then has 30 days to record the satisfaction, or it owes you $500 plus any actual damages and attorney fees.

Is there a transfer fee on a Wisconsin HELOC?

No. Wisconsin's real estate transfer fee doesn't apply to a conveyance made solely to secure a debt, such as a HELOC mortgage.

Does Wisconsin's homestead exemption protect my home from a HELOC lender?

No. The $75,000 homestead exemption protects against most creditors, but the law expressly excepts mortgages.

How long before a foreclosure sale in Wisconsin?

For an owner-occupied home of 1 to 4 units, at least 6 months after the court judgment on mortgages signed since April 27, 2016, or 12 months on older ones. You can redeem the home any time before the sale.

How much have Wisconsin home prices risen?

On the FHFA House Price Index, Wisconsin prices rose 4.82% in the year to mid-2026, 6th of the 50 states and DC, and 46.0% over 5 years. From 2014 to 2025 they rose 121.8%.
