HELOCs in Nevada: how much you can borrow and the state rules that apply

Own a home in Nevada and want cash without giving up the rate on your current mortgage? A home equity line of credit can do that. Nevada has no special HELOC borrowing cap, but as a community property state it often needs both spouses to sign, it sets out how a line is closed when you sell, and it charges no transfer tax on the loan. Here is what that means for you.

HELOC rates in Nevada right now

Most HELOCs have a variable rate based on the prime rate plus a margin set by the lender. Your margin depends mostly on your credit and how much of your home's value you borrow.

In 2025, the median HELOC in Nevada opened at 8.00%, and half opened between 6.76% and 9.00%, across 6,666 lines reported under federal HMDA data. The national median was 7.50%. Leaving out lines with a 3 to 12 month introductory rate, the Nevada median was 8.24%. Home equity loans in Nevada, which usually have a fixed rate, closed at a median of 8.75%. The Federal Reserve raised rates on September 16, 2026, which moved prime to 7.00%. Its October 27 and 28 meeting is more recent than the prime rate data shown here, which runs through October 27, 2026. Its next meeting is December 8 and 9. With 30-year mortgage rates above 7%, a HELOC lets you borrow against your equity without refinancing a lower rate you already have.

How much can you borrow in Nevada?

Nevada law doesn't set a home equity borrowing cap. Each lender sets its own limit on all the loans on your home combined, your current mortgage plus the new line.

Nevada homes are valued above the national median: $455,500 for an owner-occupied home, against $360,600 for the U.S. as a whole.

The Nevada rules that affect a HELOC, in plain English

Nevada has no special HELOC limits like a borrowing cap or a waiting period. These Nevada laws still shape your HELOC. They come from the Nevada Revised Statutes, summarized here in plain words.

Spouses and signing

Both spouses sign for community property.
Nevada is a community property state. Neither spouse can borrow against community real property unless both sign and acknowledge the deed of trust.
A declared homestead needs both signatures.
If you have recorded a declaration of homestead, a loan secured by the home isn't valid without both spouses' signatures.

Your line of credit

Closing the line when you sell or refinance.
Your escrow or title company can present your signed instruction to suspend and close the line. The lender must suspend it for at least 30 days, then close it and release the lien once the payoff is made. Any amount still owed after that remains your debt.
Stopping future draws.
If your deed of trust says it follows Nevada's future-advance law, you can end future draws with a written notice delivered in person or by certified mail. The lender must record a statement of what you owe within 4 business days, or you can record one yourself.
Ability to repay is required.
A lender can't make a home loan in Nevada without determining, by commercially reasonable means, that you can repay it.

Taxes and licensing

No transfer tax on a HELOC.
Nevada's real property transfer tax applies to deeds that convey property. The law expressly leaves out deeds of trust.
Property tax increases are capped.
On a single-family home that is your primary residence, the property tax bill generally can't rise more than 3% a year, apart from improvements or a change in use. Claims go through your county assessor.
Use a licensed lender.
Mortgage companies and loan originators need a license from the Nevada Division of Mortgage Lending. Banks and credit unions are exempt.

If you can't pay

Usually no court case.
Most Nevada foreclosures are trustee's sales under the deed of trust, without a lawsuit.
At least 3 months to a sale.
A sale can't happen until at least 3 months after the notice of default is recorded. On an owner-occupied home you can make up the missed payments until 5 days before the sale.
Mediation for owner-occupied homes.
The notice of default explains how to ask for mediation. You petition the district court within 30 days and pay a $25 fee plus your share of the mediation fee, and the sale waits until mediation is done.
No buying it back after the sale.
A trustee's sale is final. Nevada law gives no right of redemption afterward.
Limits on what is still owed.
If the sale doesn't cover the debt, the lender has 6 months to ask a court for the rest, and the amount is capped using the home's fair market value.
Homestead protection doesn't cover a HELOC.
Nevada protects up to $605,000 of equity in a declared homestead from court judgments, but the law expressly excludes a line of credit or home equity loan you took against the home.

Frequently asked questions

Does my spouse have to sign my Nevada HELOC?

Yes if the home is community real property: Nevada requires both spouses to sign and acknowledge any loan against it. Both must also sign if you have recorded a declaration of homestead.

What happens to my HELOC when I sell or refinance in Nevada?

Your escrow or title company presents your signed instruction to suspend and close the line. The lender suspends it for at least 30 days, then closes it and releases the lien once the payoff is made.

Do I pay real property transfer tax on a HELOC in Nevada?

No. Nevada's transfer tax applies to deeds that convey property, and the law expressly excludes deeds of trust.

Does Nevada's homestead exemption protect my home from a HELOC lender?

No. The $605,000 homestead exemption protects against court judgments, but the law expressly excludes a line of credit or home equity loan taken against the home.

Is foreclosure in Nevada done through the courts?

Usually not. Most are trustee's sales, held at least 3 months after a notice of default is recorded. Owners of owner-occupied homes can petition for mediation within 30 days of the notice.

How much have Nevada home prices risen?

On the FHFA House Price Index, Nevada prices rose 2.77% in the year to mid-2026 and 28.7% over 5 years. From 2014 to 2025 they rose 148.5%.
