HELOCs in Delaware: how much you can borrow and the state rules that apply

Own a home in Delaware and want cash without giving up the rate on your current mortgage? A home equity line of credit can do that. Delaware has no special HELOC borrowing cap or waiting period, but its laws cover how your line is secured, what a lender can charge when you close it, and how fast the lien comes off after you pay. Here is what that means for you.

HELOC rates in Delaware right now

Most HELOCs have a variable rate based on the prime rate plus a margin set by the lender. Your margin depends mostly on your credit and how much of your home's value you borrow.

In 2025, the median HELOC in Delaware opened at 7.50%, and half opened between 6.50% and 8.58%, across 3,346 lines reported under federal HMDA data. The national median was 7.50%. Leaving out lines with a 3 to 12 month introductory rate, the Delaware median was 7.65%. Home equity loans in Delaware, which usually have a fixed rate, closed at a median of 8.68%. The Federal Reserve raised rates on September 16, 2026, which moved prime to 7.00%. Its October 27 and 28 meeting is more recent than the prime rate data shown here, which runs through October 27, 2026. Its next meeting is December 8 and 9. With 30-year mortgage rates above 7%, a HELOC lets you borrow against your equity without refinancing a lower rate you already have.

How much can you borrow in Delaware?

Delaware law doesn't set a home equity borrowing cap. Each lender sets its own limit on all the loans on your home combined, your current mortgage plus the new line.

Delaware homes are worth more than the national median: $371,600 against $360,600 for the U.S. That gives many owners room to borrow, even though fewer own free and clear (37.2% against 40.3% nationally).

The Delaware rules that affect a HELOC, in plain English

Delaware has no special HELOC limits like a borrowing cap, a waiting period or a state right to cancel. These parts of the Delaware Code still shape your HELOC.

Your line of credit

One mortgage covers every draw.
A recorded mortgage can secure future advances, even if nothing is borrowed at closing. Your balance can go up and down, but it can never exceed the maximum amount the mortgage states.
The rate is set by your agreement.
For banks based in Delaware and lenders licensed by the State Bank Commissioner, the rate on a credit line is whatever the agreement sets or the formula it describes. Delaware law adds no rate cap.
Use a licensed lender.
Anyone in the business of lending money in Delaware needs a license from the State Bank Commissioner. Banks, federal credit unions and insurance companies are exempt.

Paying off and closing the line

No penalty for paying the balance in full.
Delaware banks and licensed lenders can't charge you for paying off what you owe on a credit line.
A fee to close the line is allowed.
If your agreement says so, those lenders may charge a fee when you pay off and close a line secured by your home. Check the agreement for a termination or early closure fee before you sign.
The lien must come off within 60 days.
After you pay in full, the lender must record the release within 60 days. The fee to record it is yours to pay unless the mortgage says otherwise. If it doesn't, you can send a demand by certified mail. A lender that willfully fails can be fined up to $1,000 and owe you damages.
A closing attorney can close the line for you.
When a Delaware attorney pays off your HELOC, for example at a sale or refinance, the attorney can instruct the lender in writing to close the line so no more money can be drawn.

Costs

No transfer tax on the mortgage.
Delaware's realty transfer tax applies to deeds, and the law says a mortgage is not a taxable document. A HELOC isn't taxed like a sale.
Low property taxes.
The median Delaware homeowner pays $1,750 a year in property tax, about half the U.S. median of $3,211.
A school tax credit for seniors.
Homeowners 65 or older can get a credit of 50% of their regular school property taxes, up to $500, on their primary residence. If you moved to Delaware in 2018 or later, you need 10 years of residency first. Apply by April 30.

If you can't pay

It goes through a court.
A Delaware lender forecloses by filing an action in the Superior Court of the county where your home is, and the court decides whether the home is sold.
45 days notice first.
For a home you live in, the lender must send a notice of intent by certified and first-class mail at least 45 days before filing. It must show the amount to bring the loan current, a year of payment history and where to get free housing counseling.
Automatic mediation.
If the lender files, a mediation conference is set 45 to 75 days after you're served, and no judgment can be entered until the day after it. To take part, meet with a HUD-approved housing counselor and file a certificate of participation within 30 days. The lender pays the mediation fee.
A chance to apply for help.
Before any judgment, the lender must swear it gave you the chance to apply for the loss mitigation programs you may qualify for, such as a loan modification.

Frequently asked questions

Is there a limit on how much equity I can borrow in Delaware?

Delaware law doesn't set one. Lenders set their own limit on all the loans on your home combined; 80% of the home's value is a common limit.

Can a Delaware lender charge me for paying off my HELOC?

Delaware banks and licensed lenders can't charge a penalty for paying the balance in full. If the agreement says so, they may charge a fee when you pay off and close a line secured by your home, so check for it before you sign.

How long does my lender have to release the mortgage after I pay off my HELOC?

Sixty days. If the release is not recorded, you can send a demand by certified mail, and a lender that willfully fails can be fined up to $1,000 and owe you damages.

Do I pay realty transfer tax on a HELOC in Delaware?

No. Delaware's realty transfer tax law says a mortgage is not a taxable document, so the tax applies to sales, not to a HELOC.

What happens if I fall behind on a Delaware HELOC?

For a home you live in, the lender must send a notice at least 45 days before it can file a foreclosure in Superior Court. If it files, you are offered automatic mediation, and no judgment can be entered before the mediation date.

How much have Delaware home prices risen?

On the FHFA House Price Index, Delaware prices rose 3.31% in the year to mid-2026, 21st of the 50 states and DC, and 37.3% over 5 years. From 2014 to 2025 they rose 90.2%.
