HELOC rates in Arkansas right now
Most HELOCs have a variable rate based on the prime rate plus a margin set by the lender. Your margin depends mostly on your credit and how much of your home's value you borrow.

The Arkansas rules that affect a HELOC, in plain English
Arkansas has no special HELOC limits like a borrowing cap or a waiting period. These Arkansas laws (the Arkansas Code) still shape your HELOC.
Spouses and signing
- Your spouse must sign.
- If you are married, a mortgage on your homestead isn't valid unless your spouse joins in signing it, or signs a separate document, and acknowledges it. That includes a home equity line.
- Dower still exists.
- If a married owner dies leaving a spouse and a child, the spouse can have a life interest in a third of the land the owner held during the marriage, unless that right was given up in legal form.
Costs and paying off
- No transfer tax on the mortgage.
- Arkansas's real property transfer tax doesn't apply to a document given only to secure a debt, so a HELOC mortgage isn't taxed as a sale.
- 60 days to clear the lien.
- Once you pay in full and ask, the lender must record that the mortgage is satisfied. A lender that fails to within 60 days can owe you up to the amount of the mortgage.
- Use a licensed lender.
- Mortgage bankers, brokers, servicers and loan officers need a license from the Arkansas Securities Commissioner.
If you can't pay
- Two ways to foreclose.
- A lender can foreclose through a court case or, if it qualifies, through an out-of-court statutory foreclosure.
- Your loan papers first.
- At least 10 days before starting an out-of-court foreclosure, the lender must mail you copies of your loan documents, who holds the note, and information on loan modification or forbearance.
- At least 60 days before an out-of-court sale.
- The lender must record a notice of default and intention to sell and wait at least 60 days before the sale. You get a copy by certified and first-class mail.
- No buying it back after that sale.
- An out-of-court foreclosure sale ends all rights of redemption.
- Limits on what is still owed.
- After an out-of-court sale, the lender has 12 months to sue for any shortfall, and the amount is capped using the home's fair market value.
- One year to redeem after a court sale.
- After a court-ordered sale you can buy the home back within one year by paying the sale price plus interest and costs, unless your mortgage waived that right.
Property tax basics
- $675 homestead credit.
- From the 2026 assessment year, the homestead property tax credit cuts the tax on your home by up to $675 a year. Apply with your county assessor.
- 5% yearly cap.
- The taxable value of your homestead can rise only 5% a year until it reaches full assessed value. New construction and major improvements aren't covered.
- A freeze at 65 or disabled.
- Once you turn 65 or become disabled, your homestead's taxable assessed value can be frozen.

Frequently asked questions
Does my spouse have to sign my Arkansas HELOC?
If you are married and the home is your homestead, yes. Arkansas law says a mortgage on a married person's homestead isn't valid unless the spouse joins in signing it and acknowledges it.
How fast must an Arkansas lender release my HELOC lien?
Once you pay in full and ask, the lender must record that the mortgage is satisfied. A lender that fails to within 60 days can owe you up to the amount of the mortgage.
Do I pay transfer tax on a HELOC in Arkansas?
No. Arkansas's real property transfer tax doesn't apply to a document given only to secure a debt.
Is foreclosure in Arkansas done through the courts?
It can be either. An out-of-court statutory sale needs at least 60 days after a recorded notice and ends any right to buy the home back. After a court sale you have one year to redeem, unless your mortgage waived it.
Can an Arkansas lender sue me for a shortfall after foreclosure?
After an out-of-court sale, the lender has 12 months to sue, and the amount is capped using the home's fair market value at the date of sale.
